A Coalition of 50 House Democrats Moves to Activate Section 4 of the 25th Amendment through Independent Oversight

On April 14, 2026, Ranking Member Jamie Raskin (D-MD) officially introduced the Oversight Commission on Presidential Capacity Act. This legislation seeks to fulfill a long-neglected provision of Section 4 of the 25th Amendment, which allows Congress to establish a permanent “body” to evaluate whether a president is “unable to discharge the powers and duties of his office.”

The push followed a week of escalating tension in Washington, triggered by the President’s public threats regarding the conflict with Iran—specifically a statement referencing the “annihilation of a whole civilization”—and a series of incoherent social media posts. The movement gained critical mass after Raskin’s formal request for a neurological evaluation from White House Physician Captain Sean Barbabella went unanswered.

Understanding the Commission’s Structure

The bill does not immediately remove a president. Instead, it creates a 17-member nonpartisan commission comprised of medical experts and retired statespersons to provide an objective assessment of fitness.

  • Medical Panel: 4 physicians and 4 psychiatrists selected by congressional leaders from both parties.
  • Leadership Panel: 8 retired executive branch officials (former Presidents, Vice Presidents, Attorneys General, or Surgeons General).
  • The Chair: A 17th member elected by the other 16 to ensure a tie-breaking, independent voice.

The Path Forward

Despite the length of the cosponsor list, the constitutional threshold remains the highest in American law. For the commission to act, it must have the concurrence of Vice President JD Vance.

If the President contests the commission’s finding of incapacity, the issue moves to Congress, where a two-thirds vote in both the House and the Senate is required to keep the Vice President as Acting President. While the bill’s passage in the Republican-controlled House faces steep odds, proponents like Rep. Seth Moulton and Rep. John Larson argue that establishing this body is a national security necessity to ensure the continuity of government during a leadership crisis.
